The delayed-payment remedy under the MSMED Act is primarily available to qualifying micro and small enterprises supplying goods or services. Eligibility, Udyam details, the date of supply and the facts of the transaction should be checked before a claim is prepared.

The official MSME Samadhaan portal currently directs new delayed-payment applications to the MSME ODR portal. The correct portal and jurisdiction should be confirmed at the time of filing because government processes may be updated.

Important records include the Udyam certificate, purchase order, contract, invoices, delivery challans, acceptance proof, ledger, bank records and payment correspondence. Emails, messages and written acknowledgements can also help establish the supply, due date and unpaid amount.

Under the MSMED Act framework, a buyer may be liable for compound interest with monthly rests at three times the RBI-notified bank rate. The calculation should use the correct due date, payment history and principal amount for each invoice.

The concerned Micro and Small Enterprises Facilitation Council examines and handles the reference through the applicable process, which may include conciliation and arbitration. The Ministry of MSME FAQ states that action on an application is taken by the concerned MSEFC.

These records show what was ordered, when it was supplied, the agreed payment terms and whether the buyer accepted the goods or services. Clear documentation makes it easier to answer disputes about quality, quantity, delivery or the amount due.

The supplier should organize the contract, invoice, delivery evidence, inspection records and all communications before replying. A factual response that addresses each objection is generally stronger than repeated payment reminders without supporting documents.

The supplier should identify the correct department, purchase authority, acceptance records and payment office before filing. Contract conditions, portal records and correspondence are especially important when several officials or agencies were involved.
